These Terms of Service govern your use of this website and online ordering service provided by Munch & Bite. By browsing the website, creating an account, placing an order, participating in our loyalty program, redeeming a promotion, or otherwise using the service, you agree to these Terms and to our Privacy Policy, Refund and Cancellation Policy, and Delivery and Pickup Policy.

1. Who you are dealing with

Your food order is made with Munch & Bite. We are responsible for our menu, prices, taxes, ingredients, allergens, order acceptance, preparation, pickup, delivery choices, refunds, loyalty program, customer service, and compliance with laws that apply to our restaurant.

This website may use Restomer technology. Restomer is a technology provider, not the restaurant, and does not prepare food, employ our restaurant staff, determine menu content, or become the seller of food or beverages to you.

2. Eligibility and account security

You must provide accurate information and be legally able to place an order in your jurisdiction. You are responsible for all activity through your account and for protecting your password, sign-in method, device, and access to your email or phone number. Tell us promptly if you suspect unauthorized account activity.

We may require verification, decline account registration, suspend an account, or restrict use where we reasonably believe there is fraud, misuse, a security risk, a violation of these Terms, or a legal requirement to do so.

3. Menu information, prices, and availability

We aim to keep our menu, descriptions, photos, prices, taxes, promotions, dietary labels, and availability current. Errors can occur. Menu images are illustrative and may not exactly represent the item served. We may correct errors, change prices, limit quantities, substitute unavailable items with your approval where practical, or cancel an order before fulfillment where necessary.

Prices, taxes, delivery fees, third-party delivery quotes, gratuities, payment processing fees, and other applicable charges are shown at checkout when available. Prices may change without notice before an order is submitted. A quoted total may be adjusted only where permitted by law and after we notify you or obtain consent where required.

4. Allergies, dietary requirements, and food safety

Food may be prepared in facilities where allergens, gluten, nuts, dairy, eggs, shellfish, meat, and other ingredients are present. Dietary labels, ingredient descriptions, filters, and notes are provided for convenience and are not a guarantee that an item is allergen-free or suitable for every dietary requirement.

If you have an allergy, severe intolerance, or other dietary concern, contact us before ordering. Do not rely solely on an online note. We may be unable to accommodate every request, and we may decline a request where we cannot safely meet it.

5. Placing an order

Submitting an order is an offer to purchase from us. An order is not accepted until we confirm it or begin preparing it. We may refuse, cancel, or limit an order where an item is unavailable, the restaurant is closed, the address is outside our delivery area, payment is not authorized, information is incomplete, a pricing or technical error occurred, fraud is suspected, or fulfillment is not reasonably possible.

You are responsible for reviewing the order, delivery address, pickup details, contact information, selected options, and total before submitting it. Once preparation begins, changes and cancellations may not be possible.

6. Payment

Online payments are processed by Stripe or another payment provider enabled for our restaurant. By submitting payment details, you authorize the applicable provider to charge the approved amount, including authorized adjustments, taxes, delivery fees, tips, and disclosed payment processing fees.

Payment approval does not guarantee that an order can be fulfilled. If we cannot fulfill a paid order, we will handle cancellation or refund eligibility under our Refund and Cancellation Policy. Payment-provider decisions, wallet availability, bank holds, refund timing, disputes, and chargebacks are outside our direct control.

Where available, payment at the restaurant may be accepted by cash, card, or another method shown at checkout. We may change or withdraw a payment method at any time.

7. Pickup and delivery

Pickup and delivery are subject to our operating hours, capacity, service area, driver availability, weather, traffic, building access, payment approval, and the information you provide. Estimated times are estimates only, not guarantees.

For delivery, you must provide an accurate, accessible address and be reasonably available by phone if needed. You are responsible for any restrictions, security access, gate codes, apartment details, parking instructions, age-verification requirements, or other information required for a safe delivery. 8. Cancellations, refunds, and disputes

Cancellation and refund eligibility depends on the order status, the reason for the request, preparation already completed, delivery status, payment method, and applicable law. Please read our Refund and Cancellation Policy and contact us promptly if there is an issue.

You agree to contact us first to give us a reasonable opportunity to resolve an order concern. This does not limit rights that cannot be waived under applicable consumer-protection law.

9. Loyalty, promotions, and discount codes

Loyalty points, rewards, promotions, coupons, referral offers, and discount codes are offered at our discretion and may have separate terms, expiry dates, usage limits, eligible items, minimum spend requirements, one-time use restrictions, or other conditions. They have no cash value unless required by law.

We may correct, refuse, suspend, cancel, or reverse a promotion, reward, or points balance where we reasonably believe there is an error, misuse, fraud, duplicate account activity, a technical issue, or a breach of these Terms. We may change or end a loyalty or promotion program prospectively, subject to applicable law.

10. Acceptable use

You must not misuse this website or attempt to interfere with it. You must not access accounts or systems without authorization, use automated tools to scrape or overload the service, submit false orders, circumvent promotions, introduce malicious code, infringe another person's rights, harass staff, or use the service for an unlawful purpose.

11. Third-party services and links

This website may link to or use services provided by third parties, including payment processors, delivery providers, maps, social networks, analytics providers, and external ordering partners. Those services are governed by their own terms and privacy notices. We are not responsible for third-party services, content, availability, or practices except to the extent required by law.

12. Intellectual property

The restaurant name, logo, menu descriptions, images, website design, text, and other content are owned by or licensed to Munch & Bite or our licensors. You may use the website for personal, lawful ordering purposes. You may not copy, reproduce, resell, modify, or exploit website content without written permission, except as allowed by law.

13. Disclaimers and limitation of liability

To the maximum extent permitted by law, the website and online ordering service are provided on an "as available" basis. We do not guarantee that the website will always be available, error-free, secure, or free from delays caused by internet, device, payment-provider, delivery-provider, or third-party systems.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Subject to that statement, Munch & Bite is not liable for indirect, incidental, special, punitive, or consequential loss, or for loss of profits, data, goodwill, or opportunity arising from use of the website, except where applicable law provides otherwise.

14. Governing law and severability

These Terms are governed by the laws of the jurisdiction where Munch & Bite operates, without regard to conflict-of-law rules, except where consumer-protection laws require otherwise. If any provision is found unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.

15. Changes to these Terms

We may update these Terms from time to time. The current version will appear on this website with a revised "Last updated" date. Continued use after an updated version becomes effective means you accept the updated Terms, except where notice or consent is required by law.
